These Terms of Service ("Terms") govern your access to and use of azulinteractiv.com (the "Site"), operated by Azul Interactiv LLC ("Azul Interactiv," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
1. What these Terms cover
These Terms cover your use of this website — the pages, content, contact form, and chat widget. They do not govern client work. If we engage to build something for you, that engagement is governed by a separate written agreement between us, which controls scope, deliverables, timelines, fees, ownership, and confidentiality. Nothing on this Site is an offer, a quote, or a contract.
2. Informational purpose only
The Site — including our services pages, case studies, and blog — is provided for general information. It does not constitute professional, legal, financial, or technical advice, and you shouldn't rely on it as the sole basis for a business decision. Descriptions of our services are summaries, not commitments; every engagement is scoped individually.
3. Contacting us through the Site
When you submit our contact form or use our chat, you agree to provide accurate information and not to impersonate anyone else. Submitting an inquiry doesn't create a client relationship, an engagement, or any obligation on our part to provide services. A client relationship begins only when both parties sign a written agreement.
Please don't send confidential or sensitive information through the contact form or chat. Until an engagement and confidentiality terms are in place, we can't treat what you send as confidential.
4. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorized access to the Site, its systems, or related infrastructure;
- Interfere with or disrupt the Site, including by probing, scanning, overloading, or introducing malicious code;
- Scrape, harvest, or systematically extract data from the Site without our written permission;
- Use the contact form or chat to send spam, solicitations, or abusive content;
- Misrepresent your identity or affiliation.
5. Intellectual property
The Site and its contents — including text, design, graphics, logos, code, and the Azul Interactiv name and marks — are owned by Azul Interactiv LLC or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, revocable license to view and use the Site for its intended purpose. You may not copy, reproduce, republish, or create derivative works from the Site without our written permission.
This section concerns the Site. Ownership of work we build for clients is addressed in the applicable engagement agreement.
6. Third-party links and services
The Site links to and integrates third-party services (for example, our chat widget and advertising platforms). We don't control those services and aren't responsible for their content, availability, or practices. Your use of a third-party service is governed by that party's terms and privacy policy.
7. Privacy
Our handling of your information is described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Disclaimer of warranties
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don't warrant that the Site will be uninterrupted, timely, secure, error-free, or that any content is accurate, complete, or current. 9. Limitation of liability
To the fullest extent permitted by law, Azul Interactiv LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or relating to your use of the Site — whether based in contract, tort, strict liability, or any other theory, and even if we've been advised of the possibility. Our total aggregate liability arising from or relating to the Site will not exceed one hundred U.S. dollars (US $100). Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Azul Interactiv LLC and its members, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of another.
11. Changes to the Site and these Terms
We may modify or discontinue the Site, or any part of it, at any time without notice. We may also update these Terms; when we do, we'll revise the "Last updated" date above. Your continued use of the Site after changes take effect means you accept the revised Terms.
12. Governing law and venue
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Arizona, and you consent to their personal jurisdiction.
13. Severability and entire agreement
If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site — and are separate from any engagement agreement we may sign with you.
